TEXAS BONDED TITLE PROCESSING WORKFLOW
Please read these instructions thoroughly the first time, then go through them a second time to perform the steps needed to solve your situation.
Bold Blue Titles represent documents that have been prepared using your submitted data and are included in this ebook. These documents will need to be printed and signed prior to submission.
Always make copies of all your documents after applying a signature to keep for your records.
Things to Consider First
- Is the vehicle last registered out of state? If so, it will need to be inspected by the Auto Theft Division of a local law enforcement agency. Once inspected, they will complete a Law Enforcement Identification Number Inspection (Form VTR-68-A). This form can only be obtained upon inspections by a law enforcement agency.
- Plan to have someone assist in processing? You'll need to give them the authority to sign and date any other documents that may be needed. Do this by signing a State of Texas Power of Attorney to Transfer Vehicle Title (POA).
Part 1: Department of Motor Vehicle Processing
- You or your Rep will need to present the following list of documents to a service window at any Texas DMV Office.
- Power Of Attorney (ID's for you and your Rep are again required)
- Bonded Title Application - SOF
- Bill of Sale
- They will charge you $15 cash ( No Cards Accepted) and issue a "Letter of Rejection" (LOR). You have a 1 year time period to finalize your bonding process from the date that appears in this letter.
Part 2: Vehicle Bonding Processing
- Once you've obtained the Letter of Rejection which determines your Surety Bond Value from the DMV Office, you will need to
Submit Your Case Documents for Surety Bond Processing.
- Once you've received your Surety Bond, it will need to be signed by you or in the "POA Format" by your representative. You will have a period of 30 days from the date that appears on the Bond Document to finalize the payment of Tax, Title, and License as laid out in the next step. Should you go beyond the 30 days, the Bonding company will charge a $85 fee to correct the date and reissue a new bond.
Part 3: County Accessor-Collector Processing
- You will need to present the following list of documents to a service window at any County Tax Assessor's Office.
- Texas Title Transfer Application
- Power Of Attorney (ID's for you and your Rep are again required)
- Bonded Title Application-Statement Of Fact - You must present all of the original documents you submitted at the Texas DMV Office that were used to process your Letter of Rejection.
- Letter of Rejections: This is a two page response letter issued by the DMV that establishes the amount of the Surety Bond that needs to be purchased to complete your bonding process.
- Surety Bond Documents
- Insurance: Proof of Insurance must be in the name of the person who is applying for a title, be active for more than 30 days and not be expired
- Emissions / Safety Inspection Receipt: this can be obtained by submitting your vehicle for inspection at any service station. It can not be older than 90 days and must be the original receipt provided by the service station.
- Bill of Sale
- Title Only Application: use this form if you wish to only transfer ownership. This will eliminate the proof of Insurance and Safety Inspection requirements until the vehicle can be made road-worthy. If the vehicle has current window stickers and plates, they will need to be relinquished.
- Your County will process and calculate TAX, TITLE AND LICENSE FEES for payment (Cards Accepted with a % processing fee) then provide you with a Transfer Receipt, Plates & Stickers (if purchased) and a certified title should arrive via U.S. Mail in 3 to 4 weeks
APPLYING SIGNATURES TO DOCUMENTS
Please read these instructions carefully as they are critical to the performance of your service.
Always review your documents for the correct spelling of customers Full Legal Name, Address, Vehicle Data, particularly Vin#, and Dates of Sale to ensure that all documents coincide with the same information.
It is probably best practice to sign and date a document just prior to presenting it to an agency service window. They will reject your documents if they are not signed or date correctly at the time of submission.
Also, be mindful of dating all documents to ensure that dates coincide with each other and that they are no more than 30 days past. Any date more than 30 days past will incur penalties. Therefore, it is a good idea not to date your documents until you are actually prepared to process them.
POWER OF ATTORNEY TO TRANSFER (POA)
- OWNER MUST SIGN using their signature where it says "Signature of Grantor" and apply date at the bottom of the form and include "Grantee" information if you intend to have some else perform finalization through the county office for you.
BONDED TITLE - STATEMENT OF FACT (BT-SOF)
- Applicant / Owner will need to place a signature on the "Signature of Applicant" line at the bottom of the page. And the same applies here as above for additional applicants.
TEXAS TITLE TRANSFER APPLICATION
- Applicant / Owner will need to place a signature on the "Signature of Applicant/Owner" field number 36 at the bottom of the page. If there are additional Applicants / Owners, their info will need to be filled by hand in the "Additional Applicant" area and place their signature at the bottom of this form as well.
BILL OF SALE (BOS)
- This document does not require any signatures but does require that you write "Owner Unavailable" in the "Printed Name" area and is required to be presented when submitting your applications.
TEXAS TITLE ONLY APPLICATION
- Applicant / Owner will need to place a signature on the "Signature" line at the bottom of the page. This form is only required when you intend to only transfer ownership without purchasing vehicle registration. If a vehicle has current registration and you wish to use this form to avoid showing proof of insurance, you will need to relinquish the current plates and window stickers when submitting this form.
